FDA Cracks Down on Cancer Quacks

The U.S. Food and Drug Administration is the agency that regulates food additives or supplements, drugs and ingredients in the United States.

This week the FDA sent out official warning letters to 25 companies who sell so-called "natural" treatments for cancer that they are violating the law. The FDA called the letters "Fake cancer cures warning letters".

Here is a list of the companies, taken from the FDA.gov web-site news release "125 Fake Cancer 'Cures' Consumers Should Avoid":

in the Banned Supplements?

Are These Products
Totally Unhealthy?

No, not necessarily -- that's not the FDA's point. They argue simply that these products haven't been PROVEN to be safe and effective treatment for disease, i.e. cancer. This does not mean that consumers should stay away from any natural product. It means that they should never rely on that product to treat or cure their disease. This is an interesting distinction.

And, with the strongest possible wording the FDA warns consumers to "stay away" from these products. They use terms like "fakes, quacks, frauds, fraudulent" and so on.

The companies who make the banned items are facing civil and criminal prosecution, which could include product siezures, judicial injunctions, fines or even jail. Pretty serious stuff.

The FDA says "Because these products claim to cure, treat, mitigate or prevent disease, and these products have not been shown to be safe and effective for their labeled conditions of use, they are unapproved new drugs marketed in violation of the Federal Food, Drug, and Cosmetic Act."

Read that carefully. There are several areas to be considered in this FDA statement:
  1. THE PRODUCT'S CLAIM: "claim to cure, treat, mitigate or prevent disease"
  2. UNTESTED, UNPROVEN STATUS: "not been shown to be safe and effective"
  3. LABELING: "for their labeled conditions of use"
  4. CONCLUSION: "they are unapproved drugs"

Can We Still Buy and Consume
the Basic Ingredients Anyway?

The true natural ingredients themselves have not been banned presently by the FDA. For example some of the products above contained curcumin, which is an extract from the yellow curry spice called commonly turmeric. Can we still buy turmeric or supplements containing the concentrated curcumin extract? So far, yes we can. However the manufacturers cannot make claims about curcumin or turmeric being a cure for cancer (or any other disease).

This restriction on making claims to treat, prevent, cure or mitigate diseases is applied to any and all foods, supplements, extracts, powders, potions, cremes and other products.

We can usually buy a food product or supplement in the USA, unless someone has claimed that the product will be a treatment of some kind for a disease. Then, we may have a problem finding that product where the claim is made.

Manufacturers beware! Don't make unproved claims for your so-called natural products. Even if you think the science is good behind the product, the FDA is watching -- don't make claims of disease treatments, cures, mitigation or prevention in any form for your product. Not online, not on the label, not on TV or radio, not in print ads, not anywhere. Avoiding claims on the label is not enough. No claims can be made by you, period.

The Emotion Behind This Controversy

People get a little crazy when they read about the FDA taking actions like this. However, remember that no matter what underlying motives may cause these warnings from the FDA -- whether angelic or devilish -- they do represent the law in the USA. The way to deal with them if you dissagree is to contact your congressman, senator or other elected officials. Our society is governed, at the end of the day, by laws, not men. If you don't like a law, you can change it.

In the meanwhile, you should in fact investigate all possible avenues to learn about conditions relating to your health. There are thousands of peer-reviewed studies being performed every day in the world. They are researchable widely online at sources like the NIH site Pubmed.gov. If you're having a health problem, do some research, take some notes and discuss your findings with your physician or health professional. He or she can advise you about what therapies to take -- whether a natural product, or a patented prescription drug -- to deal with your complaint. That's the wise choice.
